The following terms and conditions apply to sweepstakes advertised by means of a sweepstakes post on the on Metall LinkedIn page.
By participating in the sweepstakes, the participant agrees to these terms and conditions.
1. Organizer of the sweepstakes
The organizer of the sweepstakes is on Metall GmbH, Zum Dümpel 60, 59846 Sundern (hereinafter also referred to as “Organizer”).

2. General
a) The sweepstakes is not affiliated with LinkedIn and is in no way sponsored, endorsed, or organized by LinkedIn.
b) LinkedIn is released from any claims for damages that may arise during the execution of the sweepstakes.
c) The information about the sweepstakes is not provided by LinkedIn, but by the Organizer.
d) Questions, comments, or complaints about the sweepstakes should not be directed to LinkedIn, but to the Organizer.
3. Eligibility to participate
Any natural person of 18 years or older (as well as adolescents with the consent of their parents) who is resident in Germany may participate, with the exception of employees of the Organizer and its affiliated companies as well as their respective relatives.
4. Participation in the sweepstakes
Participation takes place by clicking the “Like” button or by adding a comment to the respective sweepstakes post with the content specified in the sweepstakes post. The respective closing date for entries can be found in the sweepstakes post.
5. Prizes
The type and number of prizes offered can be found in the respective sweepstakes post. An exchange or cash payment of the prize is not possible. The claim to the prize is not transferable.
6. Determination of winners
a) Among all participants, the number of winners mentioned in the sweepstakes post will be selected by random generator after the closing date for entries. The participants agree that they will be informed via personal message via their LinkedIn profile that they have won.
b) The winners must contact the address specified in the message within 24 hours of their winning notification (via their LinkedIn profile), stating their name, first name and address. If no timely feedback is received, the prize claim expires and another winner will be determined by the Organizer.
c) The prize will be sent after feedback from the winner.
7. Premature termination, exclusion
a) The Organizer reserves the right to cancel or terminate the sweepstakes at any time without prior notice and without giving reasons. This applies in particular if proper execution cannot be guaranteed for technical or legal reasons. In such a case, the participants have no claims against the Organizer.
b) The Organizer further reserves the right to exclude participants from participation in the sweepstakes, for example in the event of violations of the terms and conditions of participation.
c) Finally, the Organizer reserves the right to change the terms and conditions of participation or to extend or limit the time frame or to vary the content of the prizes, provided that there are objective reasons for this and the change is reasonable. It undertakes to announce any new conditions within this LinkedIn page of the Organizer.
8. Warranty/Liability
The Organizer assumes no warranty for the freedom of the advertised prizes from material defects and defects of title. Likewise, it assumes – as far as legally permissible – no liability for errors or misprints as well as for damages that may arise in connection with the provision and use of the prizes, unless they are due to intent or gross negligence of the Organizer. Liability for culpable injury to life, body or health, based on the Product Liability Act as well as a violation of essential obligations (cardinal obligations), i.e. such obligations whose compliance is essential to achieve the purpose of the sweepstakes on whose compliance the participant can rely, remains unaffected.
9. Data protection

The responsible party has appointed a data protection officer. You can reach this person at: info@on-metall.de. If participants provide the Organizer with personal data in the context of the sweepstakes, this data will be processed by the Organizer exclusively for the execution and processing of the sweepstakes and then deleted immediately. The name, first name and address of the winner will be processed by the Organizer for the purpose of sending the prize and then deleted immediately. The participants as well as the winner are neither contractually nor legally obliged to transmit their personal data to the Organizer. However, if the winner does not provide the Organizer with his name, first name and address in due time, the prize claim expires without substitution. The legal basis for the processing of personal data of the participants for the execution and processing of the sweepstakes as well as the processing of personal data of the winner for the sending of the prize is Art. 6 paragraph 1 sentence 1 lit. b) of the EU General Data Protection Regulation (GDPR). The name, first name and address of the winner will be disclosed by the Organizer to the shipping company that delivers the prize to the winner. In connection with the processing of personal data of the participants including the winner, the participants as well as the winner have the following rights: Right to information according to Art. 15 GDPR, the right to rectification according to Art. 16 GDPR, the right to erasure according to Art. 17 GDPR as well as the right to restriction of processing according to Art. 18 GDPR. Furthermore, he has the right to complain to a supervisory authority about unlawful data processing pursuant to Art. 77 para. 1 GDPR.
10. Miscellaneous
a) Should individual provisions of these terms and conditions of participation be or become invalid, the validity of the remaining provisions shall remain unaffected.
b) The legal process is excluded.
